Acceptance of these terms

These Terms of Service ("Terms") govern your use of the Varenigo website operated by IBY LLC ("Varenigo," "we," "us," or "our"). By accessing or using our site, you agree to be bound by these Terms. If you do not agree, please do not use the site.

About this site

Varenigo sells handmade frozen dumplings through this site, as one-time boxes and as subscription plans, for delivery within our delivery area. Other content on the site, such as our guides and recipes, is for general informational purposes and may change at any time.

Orders and subscriptions

Every purchase, whether a one-time box or a subscription plan, is governed by our Terms of Subscription, which cover pricing, billing, delivery, renewals, cancellation and refunds. You agree to them when you place an order. If they conflict with these Terms on anything to do with an order, the Terms of Subscription apply.

We deliver only to the areas listed when you enter your ZIP code at checkout. Prices, the menu and our delivery areas may change; the price and delivery details shown at checkout are the ones that apply to your order.

Eligibility and accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account, place an order or join our waitlist.

You are responsible for keeping your account sign-in secure and for activity under your account, and for giving us accurate contact and delivery details.

The waitlist

If we do not deliver to your area yet, you can join our waitlist. Joining does not guarantee that we will deliver to your area, or any particular pricing or timeline. By joining, you agree that we may email you when we reach your area and about related updates. You can unsubscribe at any time using the link in any marketing email.

Privacy, analytics and session recording

By using this site you agree to the practices described in our Privacy Policy and Cookie Policy, which form part of these Terms. In summary:

• We measure how the site is used - pages viewed, clicks, and the steps of our signup - from the moment you arrive, so we can improve it. You can switch this off at any time from our cookie banner or the "Cookie preferences" link in the footer.
• We record how visitors interact with our pages only where you have given permission. Nothing is recorded until you do. Everything you type into a form is masked before it leaves your browser, and card details are entered in a frame served by our payment provider that our recording cannot see into.
• If you hold a Varenigo account, your account id and email address are attached to your analytics profile so we can answer questions about your own orders. Your name, phone number and delivery address are not sent to our analytics provider.

If you do not agree to this, you can decline in our cookie banner, or stop using the site.

Acceptable use

You agree not to:

• Use the site for any unlawful purpose.
• Attempt to disrupt, abuse, overload, or interfere with the site or its security.
• Scrape, harvest, or collect data from the site using automated means without our permission.

Intellectual property

The Varenigo name, logo, and all content on this site are owned by IBY LLC or its licensors and are protected by applicable intellectual property laws. You may not use them without our prior written permission.

Disclaimers

The site is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure.

Limitation of liability

To the fullest extent permitted by law, IBY LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the site.

Changes to these terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the site after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of Indiana, USA, without regard to its conflict of laws principles.
